Mt. Pleasant Town Board Member facing criminal charges and a Federal Civil Rights lawsuit

Recently elected Mt. Pleasant Town Councilman, Denis McCarthy, appears to be off to a rocky start.  Since his election in November, 2013, Mr. McCarthy appears to have encountered some serious legal troubles.  In February, 2014, a formal criminal complaint was filed against Mr. McCarthy, with the New York State Attorney General's Office, relating to his alleged criminal conduct during the 2013 Republican Party petition/signature gathering period.  In that complaint, the following criminal charges were filed against Mr. McCarthy; each is a violation of the New York State Penal Law:
  • 175.30 - Offering a false statement for filing in the second degree (Class A Misdemeanor - up to 1 year in prison)
  • 190.65 - Scheme to defraud in the first degree (Class E Felony - up to 4 years in prison)
  • 210.15 - Perjury in the first degree (Class D Felony - up to 7 years in prison)  
  • 210.45 - Making a punishable false written statement (Class A Misdemeanor - up to 1 year in prison)
Additionally, in February, 2014, a Federal Civil Rights lawsuit was filed against Mr. McCarthy in Federal District Court, Southern District of New York [Case Number - 14 CV 1001 (KMK)].  In this suit, Mr. McCarthy is alleged to have intentionally prevented two Mt. Pleasant residents from exercising their Constitutional right to run for elected office.           

QUESTION FOR RESIDENTS
